What I cannot understand here is why everyone is dealing with this as if it were just about deportation. It involves deportation for sure, but I thought deportation meant sending a person back to where he came from. This is not deportation. It is extra-judicial sentencing to imprisonment. People are not being sent back to their homelands. They are being sent directly to prison in a foreign country with no recourse. They’re going to prison in El Salvador, convicted without trial for crimes presumed to have been committed elsewhere.
I think although the deportation issue is important, the redefinition of deportation to mean sentencing people to imprisonment without trial has much more serious implications. Even if one were to find the frivolous deportations going on to be somehow legal, this is not deportation. It is extra-judicial condemnation and sentencing. And letting this slide as if it were just about deportation is, I think, going to be fatal to Constitutional government.
